1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. EDEN PRAIRIE VOLUNTEER FIREFIGHTERS RELIEF
1.7ASSOCIATION SERVICE PENSIONS.
1.8    Subdivision 1. Lump-sum service pension maximum. (a) Notwithstanding any
1.9provision of Minnesota Statutes, section 424A.02, subdivision 3, paragraph (d), to the
1.10contrary, the maximum lump-sum pension amount for each year of service credited
1.11that may be provided for in the bylaws of the Eden Prairie volunteer firefighters relief
1.12association is the maximum service pension figure corresponding to the average amount
1.13of available financing per active covered firefighter for the applicable specified period:

5.36    (b) The maximum monthly service pension amount per month for each year of
5.37service credited that may be provided for in the bylaws of the Eden Prairie volunteer
5.38firefighters relief association must be set pursuant to Minnesota Statutes, section 424A.02,
5.39subdivision 3, paragraph (c).
5.40    Subd. 2. Return to active service. (a) Notwithstanding any provision of Minnesota
5.41Statutes, section 424A.01, subdivision 6, section 424A.02, subdivision 2, or any other
5.42provision of law, to the contrary, if the bylaws of the Eden Prairie volunteer firefighters
6.1relief association so provide, a former firefighter who has received a lump-sum service
6.2pension or is receiving a monthly benefit service pension and returns to active relief
6.3association membership under Minnesota Statutes, section 424A.01, subdivision 6,
6.4paragraph (b), is entitled to receive an unreduced lump-sum service pension for the
6.5resumption service period if the firefighter completes at least three years of active service
6.6as an active member of the fire department during the resumption service period and
6.7completes at least three years of active membership with the relief association during the
6.8resumption service period.
6.9(b) A lump-sum service pension must be calculated by applying the service pension
6.10amount in effect on the date of the firefighter's termination of the resumption service for
6.11all years of the resumption service. No firefighter may be paid a service pension more
6.12than once for the same period of service. Payment of a lump-sum service pension shall
6.13have no effect on the firefighter's previous service pension.
6.14EFFECTIVE DATE.This section is effective the day after the Eden Prairie city
6.15council and its chief clerical officer timely complete their compliance with Minnesota
6.16Statutes, section 645.021, subdivisions 2 and 3.
