1.3    "Section 1. Minnesota Statutes 2006, section 179A.10, subdivision 1, is amended to
1.4read:
1.5    Subdivision 1. Exclusions. The commissioner of employee relations shall meet and
1.6negotiate with the exclusive representative of each of the units specified in this section,
1.7except as provided in section 43A.06, subdivision 1, paragraph (c). The units provided
1.8in this section are the only appropriate units for executive branch state employees. The
1.9following employees shall be excluded from any appropriate unit:
1.10    (1) the positions and classes of positions in the classified and unclassified services
1.11defined as managerial by the commissioner of employee relations in accordance with
1.12section 43A.18, subdivision 3, and so designated in the official state compensation
1.13schedules;
1.14    (2) unclassified positions in the Minnesota State Colleges and Universities defined
1.15as managerial by the Board of Trustees;
1.16    (3) positions of physician employees compensated under section 43A.17,
1.17subdivision 4 ;
1.18    (4) positions of all unclassified employees appointed by a constitutional officer,
1.19other than the attorney general;
1.20    (5) positions in the bureau;
1.21    (6) positions of employees whose classification is pilot or chief pilot;
1.22    (7) administrative law judge and compensation judge positions in the Office of
1.23Administrative Hearings; and
1.24    (8) positions of all confidential employees.
1.25    The governor may upon the unanimous written request of exclusive representatives
1.26of units and the commissioner direct that negotiations be conducted for one or more units
2.1in a common proceeding or that supplemental negotiations be conducted for portions of a
2.2unit or units defined on the basis of appointing authority or geography."
2.3Renumber the sections in sequence and correct the internal references
2.4Amend the title accordingly
