1.5    Section 1. Minnesota Statutes 2006, section 354A.27, is amended by adding a
1.6subdivision to read:
1.7    Subd. 7. Maximum postretirement adjustment. Notwithstanding any provision
1.8of subdivision 1, 5, or 6, to the contrary, an annual postretirement adjustment under this
1.9section may not exceed the percentage amount under section 11A.18, subdivision 9,
1.10paragraph (3), clause (2), or section 11A.181, subdivision 3, paragraph (a), clause (a).

1.11    Sec. 2. Minnesota Statutes 2006, section 354A.29, is amended by adding a subdivision
1.12to read:
1.13    Subd. 5a. Maximum postretirement adjustment. Notwithstanding any provision
1.14of subdivision 3, 4, or 5, or Laws 2007, chapter 134, article 7, section 1, to the contrary,
1.15an annual postretirement adjustment under this section or under Laws 2007, chapter
1.16134, article 7, section 1, may not exceed the percentage amount under section 11A.18,
1.17subdivision 9, paragraph (3), clause (2), or section 11A.181, subdivision 3, paragraph
1.18(a), clause (a)."
