1.1A bill for an act
1.2relating to retirement; Minnesota State Retirement System; allowing service
1.3credit purchase and Rule of 90 eligibility for certain Minnesota Department
1.4of Transportation employees.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. MSRS-GENERAL RETIREMENT ELIGIBILITY CLARIFICATION;
1.7SERVICE CREDIT PURCHASE IN CERTAIN INSTANCES.
1.8(a) Notwithstanding any provision of law to the contrary, an eligible person
1.9described in paragraph (b) is entitled to purchase prior uncredited service credit under
1.10paragraph (c) and, if the service credit purchase is made, to have an effective start date
1.11for active retirement plan membership of June 1, 1989, and to retire under Minnesota
1.12Statutes, section 352.116, subdivision 1.
1.13(b) An eligible person is a person who:

3.1(4) was sent annual statements by the Minnesota State Retirement System between
3.2July 1, 2005, and July 1, 2015, from the indicating eligibility for a retirement benefit under
3.3Minnesota Statues, section 352.116, subdivision 1; and
3.4(5) was sent notification from the Minnesota State Retirement System revising the
3.5start date for general state employees retirement plan membership from a date before
3.6July 1, 1989, to a date after June 30, 1989, and indicating consequent inapplicability of
3.7Minnesota Statutes, section 352.116, subdivision 1.
3.8(c) An eligible person may purchase allowable service credit in the general state
3.9employees retirement plan of the Minnesota State Retirement System by paying an amount
3.10equal to the employer contributions and employee contributions that would have been
3.11paid from June 1, 1989, to the end of the month prior to the date the employee entered
3.12covered service plus interest at the rate of 8.5% until June 30, 2015, and eight percent
3.13thereafter compounded annually on the combined employer and employee contribution
3.14amount from the date the contributions would have been paid to the date the Minnesota
3.15State Retirement System receives payment for this service credit purchase. The payment
3.16must be made in a lump sum.
3.17(d) An eligible person who purchases allowable service credit under paragraph (c)
3.18has a June 1, 1989, start date for the purpose of allowable service credited by the general
3.19state employees retirement plan of the Minnesota State Retirement System and is eligible
3.20for a retirement annuity under Minnesota Statutes, section 352.116, subdivision 1.
3.21(e) Authority to purchase prior uncredited service credit under this section expires
3.22on July 1, 2017.
3.23EFFECTIVE DATE.This section is effective the day following final enactment.
