1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. Minnesota Statutes 2006, section 43A.346, subdivision 5, is amended to
1.4read:
1.5    Subd. 5. Appointing authority discretion. The appointing authority has sole
1.6discretion to determine if and the extent to which a postretirement option position under
1.7this section is available to a state employee. Any offer of such a position must be made
1.8in writing to the employee by the appointing authority on a form prescribed by the
1.9Department of Employee Relations and the Minnesota State Retirement System or the
1.10Public Employees Retirement Association. If the employee is under the age of 62 on
1.11the day of retirement, the offer, and any related verbal offer or agreement, must not be
1.12made until at least 30 days after the employee's retirement. The appointing authority
1.13may not require a person to waive any rights under a collective bargaining agreement or
1.14unrepresented employee compensation plan as a condition of participation.
1.15EFFECTIVE DATE.This section is effective the day following final enactment
1.16and applies to employees retiring after that date.

1.17    Sec. 2. Minnesota Statutes 2006, section 43A.346, subdivision 6, is amended to read:
1.18    Subd. 6. Duration. Postretirement option employment shall be for an initial period
1.19not to exceed one year. During that period, the appointing authority may not modify the
1.20conditions specified in the written offer without the employee's agreement, except as
1.21required by law or by the collective bargaining agreement or compensation plan applicable
1.22to the employee. At the end of the initial period, the appointing authority has sole
1.23discretion to determine if the offer of a postretirement option position will be renewed,
1.24renewed with modifications, or terminated. For retirees employed under this section who
1.25are under 62 and who retired before the effective date of this section, an offer of renewal,
1.26and any related verbal offer or agreement, must not be made until at least 30 days after
2.1termination of the employee's previous position. Postretirement option employment may
2.2be renewed for periods of up to one year, not to exceed a total duration of five years. No
2.3person shall be employed in one or a combination of postretirement option positions under
2.4this section for a total of more than five years.
2.5EFFECTIVE DATE.This section is effective the day following final enactment."
2.6Delete the title and insert:
