1.3 Delete everything after the enacting clause and insert:
1.4 "Section 1. Minnesota Statutes 2004, section 352.01,
1.5 subdivision 2a, is amended to read:
1.6 Subd. 2a. INCLUDED EMPLOYEES. (a) "State employee"
1.7 includes:
1.8 (1) employees of the Minnesota Historical Society;
1.9 (2) employees of the State Horticultural Society;
1.10 (3) employees of the Disabled American Veterans, Department
1.11 of Minnesota, Veterans of Foreign Wars, Department of Minnesota,
1.12 if employed before July 1, 1963;
1.13 (4) employees of the Minnesota Crop Improvement
1.14 Association;
1.15 (5) employees of the adjutant general who are paid from
1.16 federal funds and who are not covered by any federal civilian
1.17 employees retirement system;
1.18 (6) employees of the Minnesota State Colleges and
1.19 Universities employed under the university or college activities
1.20 program;
1.21 (7) currently contributing employees covered by the system
1.22 who are temporarily employed by the legislature during a
1.23 legislative session or any currently contributing employee
1.24 employed for any special service as defined in subdivision 2b,
1.25 clause (8);
1.26 (8) employees of the Armory Building Commission;
1.27 (9) employees of the legislature appointed without a limit
1.28 on the duration of their employment and persons employed or
1.29 designated by the legislature or by a legislative committee or
1.30 commission or other competent authority to conduct a special
1.31 inquiry, investigation, examination, or installation;
1.32 (10) trainees who are employed on a full‑time established
1.33 training program performing the duties of the classified
1.34 position for which they will be eligible to receive immediate
1.35 appointment at the completion of the training period;
1.36 (11) employees of the Minnesota Safety Council;
2.1 (12) any employees on authorized leave of absence from the
2.2 Transit Operating Division of the former Metropolitan Transit
2.3 Commission who are employed by the labor organization which is
2.4 the exclusive bargaining agent representing employees of the
2.5 Transit Operating Division;
2.6 (13) employees of the Metropolitan Council, Metropolitan
2.7 Parks and Open Space Commission, Metropolitan Sports Facilities
2.8 Commission, Metropolitan Mosquito Control Commission, or
2.9 Metropolitan Radio Board unless excluded or covered by another
2.10 public pension fund or plan under section 473.415, subdivision
2.11 3;
2.12 (14) judges of the Tax Court;
2.13 (15) personnel employed on June 30, 1992, by the University
2.14 of Minnesota in the management, operation, or maintenance of its
2.15 heating plant facilities, whose employment transfers to an
2.16 employer assuming operation of the heating plant facilities, so
2.17 long as the person is employed at the University of Minnesota
2.18 heating plant by that employer or by its successor organization;
2.19 and
2.20 (16) seasonal help in the classified service employed by
2.21 the Department of Revenue; and
2.22 (17) persons employed by the Department of Commerce in the
2.23 Insurance Fraud Prevention under section 45.0135 who have
2.24 attained the mandatory retirement age specified in section
2.25 43A.34, subdivision 4.
2.26 (b) Employees specified in paragraph (a), clause (15), are
2.27 included employees under paragraph (a) if employer and employee
2.28 contributions are made in a timely manner in the amounts
2.29 required by section 352.04. Employee contributions must be
2.30 deducted from salary. Employer contributions are the sole
2.31 obligation of the employer assuming operation of the University
2.32 of Minnesota heating plant facilities or any successor
2.33 organizations to that employer.
2.34 Sec. 2. Minnesota Statutes 2004, section 352B.01,
2.35 subdivision 2, is amended to read:
2.36 Subd. 2. MEMBER. "Member" means:
3.1 (1) a State Patrol member currently employed after June 30,
3.2 1943, under section 299D.03 by the state, who is a peace officer
3.3 under section 626.84, and whose salary or compensation is paid
3.4 out of state funds;
3.5 (2) a conservation officer employed under section 97A.201,
3.6 currently employed by the state, whose salary or compensation is
3.7 paid out of state funds;
3.8 (3) a crime bureau officer who was employed by the crime
3.9 bureau and was a member of the Highway Patrolmen's retirement
3.10 fund on July 1, 1978, whether or not that person has the power
3.11 of arrest by warrant after that date, or who is employed as
3.12 police personnel, with powers of arrest by warrant under section
3.13 299C.04, and who is currently employed by the state, and whose
3.14 salary or compensation is paid out of state funds;
3.15 (4) a person who is employed by the state in the Department
3.16 of Public Safety in a data processing management position with
3.17 salary or compensation paid from state funds, who was a crime
3.18 bureau officer covered by the State Patrol retirement plan on
3.19 August 15, 1987, and who was initially hired in the data
3.20 processing management position within the department during
3.21 September 1987, or January 1988, with membership continuing for
3.22 the duration of the person's employment in that position,
3.23 whether or not the person has the power of arrest by warrant
3.24 after August 15, 1987;
3.25 (5) a public safety employee defined as a peace officer in
3.26 section 626.84, subdivision 1, paragraph (c), and employed with
3.27 the Division of Alcohol and Gambling Enforcement under section
3.28 299L.01; and
3.29 (6) a Fugitive Apprehension Unit officer after October 31,
3.30 2000, employed by the Office of Special Investigations of the
3.31 Department of Corrections who is a peace officer under section
3.32 626.84; and
3.33 (7) a commerce employee defined as a peace officer in
3.34 section 626.84, subdivision 1, paragraph (c), employed with the
3.35 Division of Insurance Fraud Prevention under section 45.0135
3.36 after January 1, 2005, and who has not attained the mandatory
4.1 retirement age specified in section 43A.34, subdivision 4.
4.2 Sec. 3. EFFECTIVE DATE.
4.3 Sections 1 and 2 apply retroactively from January 1, 2005."
