  1.5                    SURVIVOR BENEFIT FOR SPOUSE

  1.6                     OF DECEASED POLICE OFFICER

  1.7     Section 1.  SURVIVOR BENEFIT FOR ST. LOUIS PARK POLICE 

  1.8  OFFICER KILLED IN IRAQ CONFLICT. 

  1.9     Subdivision 1.  ELIGIBILITY. (a) Notwithstanding any 

  1.10 provision of Minnesota Statutes, section 353.657, subdivision 1, 

  1.11 regarding required length of marriage, an eligible person 

  1.12 described in paragraph (b) is authorized to apply for a 

  1.13 surviving spouse annuity from the public employees police and 

  1.14 fire retirement plan to be computed under Minnesota Statutes, 

  1.15 section 353.657, subdivision 2, as limited under this section. 

  1.16    (b) An eligible person for purposes of paragraph (a) is the 

  1.17 surviving spouse of a deceased public employees police and fire 

  1.18 retirement plan member who: 

  1.19    (1) was born on October 29, 1979; 

  1.20    (2) was a member of the public employees police and fire 

  1.21 retirement plan commencing on January 24, 2004, due to 

  1.22 employment as a police officer by the city of St. Louis Park; 

  1.23 and 

  1.24    (3) died on February 21, 2005, while providing military 

  1.25 service in Iraq. 

  1.26    Subd. 2.  APPLICATION PROCESS. An eligible person 

  1.27 described in subdivision 1 is authorized to apply for the 

  1.28 applicable surviving spouse annuity on a form or forms provided 

  1.29 by the executive director of the Public Employees Retirement 

  1.30 Association.  The person must provide sufficient documentation 

  1.31 of eligibility to the executive director, as the executive 

  1.32 director may prescribe, and any other documentation and 

  1.33 information required to determine the benefit payable under this 

  1.34 section. 

  1.35    Subd. 3.  REFUND REPAYMENT AUTHORIZATION. An annuity 

  1.36 under this section is in lieu of any death refund to which an 

  2.1  eligible person would otherwise be entitled.  If an eligible 

  2.2  person has received a death refund, that person is authorized to 

  2.3  repay that refund, under the terms specified in Minnesota 

  2.4  Statutes, section 353.35, notwithstanding any law to the 

  2.5  contrary. 

  2.6     Subd. 4.  RETROACTIVE APPLICATION. If a valid benefit 

  2.7  application is made by an eligible person under this section, 

  2.8  the monthly annuity payments commence retroactive to February 

  2.9  21, 2005.  

  2.10    Subd. 5.  BENEFIT LIMITATION. The executive director of 

  2.11 the Public Employees Retirement Association shall determine the 

  2.12 sum of the present value on the effective date of this section 

  2.13 of all death benefits paid or payable by the federal government 

  2.14 due to the death of the deceased member, payments from any life 

  2.15 insurance policies, and payments from any state programs 

  2.16 providing benefits to the surviving spouse or children of the 

  2.17 deceased police officer.  The executive director shall subtract 

  2.18 this sum from $...., to determine the residual amount.  The full 

  2.19 actuarial reserves for the survivor benefit payable under this 

  2.20 section must not exceed this residual amount. 

  2.21    Subd. 6. CITY PAYMENT. The executive director shall 

  2.22 notify the chief administrative officer of the city of St. Louis 

  2.23 Park of the full actuarial reserves, if any, for the survivor 

  2.24 benefit determined under subdivision 5, and the city must pay to 

  2.25 the public employees police and fire fund ... percent of this 

  2.26 amount, payable in a lump sum within 30 days of the 

  2.27 notification.  If the city fails to pay this amount, the 

  2.28 executive director shall notify the commissioner of finance of 

  2.29 this nonpayment, and the necessary amount outstanding shall be 

  2.30 withheld from subsequent aid to the city and transmitted to the 

  2.31 executive director for deposit in the public employees police 

  2.32 and fire fund. 

  2.33    Sec. 2.  EFFECTIVE DATE. 

  2.34    Section 1 is effective on the day following final 

  2.35 enactment."
