1.3 Page 9, after line 25, insert:
1.4 "Sec. 12. Minnesota Statutes 2002, section 356B.05, is
1.5 amended to read:
1.6 356B.05 PUBLIC PENSION ADMINISTRATION LEGISLATION.
1.7 (a) Proposed administrative legislation recommended by or
1.8 on behalf of the Minnesota state retirement system, the public
1.9 employees retirement association, the teachers retirement
1.10 association, the Minneapolis employees retirement fund, or a
1.11 first class city teachers retirement fund association, or the
1.12 Minnesota state colleges and universities system must be
1.13 presented to the legislative commission on pensions and
1.14 retirement, the state and local governmental operations
1.15 committee of the senate, and the governmental operations and
1.16 veterans affairs policy committee of the house of
1.17 representatives on or before October 1 of each year in order for
1.18 the proposed administrative legislation to be acted upon during
1.19 the upcoming legislative session. The executive director or the
1.20 deputy executive director of the legislative commission on
1.21 pensions and retirement shall provide written comments on the
1.22 proposed administrative provisions to the public pension plans
1.23 by November 15 of each year.
1.24 (b) Proposed administrative legislation recommended by or
2.1 on behalf of a public employee pension plan or system under
2.2 paragraph (a) must address provisions:
2.3 (1) authorizing allowable service credit for leaves of
2.4 absence and related circumstances;
2.5 (2) governing offsets or deductions from the amount of
2.6 disability benefits;
2.7 (3) authorizing the purchase of allowable service credit
2.8 for prior uncredited periods;
2.9 (4) governing subsequent employment earnings by reemployed
2.10 annuitants; and
2.11 (5) authorizing retroactive effect for retirement annuity
2.12 or benefit applications.
2.13 (c) Where possible and desirable, taking into account the
2.14 differences among the public pension plans in existing law and
2.15 the unique characteristics of the individual public pension fund
2.16 memberships, uniform provisions relating to paragraph (b) for
2.17 all applicable public pension plans must be presented for
2.18 consideration during the legislative session. Supporting
2.19 documentation setting forth the policy rationale for each set of
2.20 uniform provisions must accompany the proposed administrative
2.21 legislation."
